Article 1 – Legal status of the contract
This contract is subject, depending on the establishment concerned, to the status of residences with services or tourist residences. This rental is concluded as a temporary residence. The premises may not be used as primary or even secondary accommodation. The resident may not practice any commercial, craft or professional activity there. The occupying resident cannot avail himself of the legal provisions applicable in the area of residential leases, in particular as regards staying in the premises. Consequently, the contract will be governed by the provisions of the civil code as well as by the conditions provided for herein.
Article 2 – Reservation
The reservation of an apartment is only valid after acceptance of the customer’s reservation by the operating company. Confirmation of the customer’s reservation by the operating company remains at its sole discretion. In addition, the reservation must, to be firm, be guaranteed by a credit card issued by a reputable institute and valid, or have been the subject of a prior credit agreement with the operating company or be followed by payment of a deposit or full payment of the stay.
The aforementioned deposit must correspond to:
– one night for stays of less than 5 nights
– two nights for stays between 5 and 27 nights
– 4 nights for stays of 28 nights and more.
Payment must be made within 7 days of booking. After this time, the reservation will be cancelled. In the event of cancellation of the reservation, the deposit may be kept in the manner specified in article 7. Unless there is a specific contractual provision, group reservations, namely reservations relating to 10 or more accommodation units, reserved by the same entity for the same period, are subject to the specific conditions of groups.
Different conditions may apply for special offers. In this case, the special features mentioned under the price description on the reservation page or on the communication medium concerned prevail over the conditions mentioned above.
Article 3 – Payment conditions
Invoices must be paid immediately upon presentation. On the day of the customer’s arrival, the operating company will invoice him for his entire stay, with the exception of stays longer than 28 nights, the invoices of which will be issued and presented monthly and payable in advance. In the event that it has been agreed that payment for a resident’s stay will be made by a third party, the resident – occupant – will remain jointly and severally liable for the payment in question. Payment for all optional services will be required upon presentation of the corresponding invoice. The credit limit accepted by the operating company for this type of service is 200 euros. The operating company will be entitled to a monthly delay interest of 1.5% on any amount not settled on its settlement date.
Article 4 – Price
The prices are indicated in euros. They are inclusive of all taxes and only include the provision of accommodation. They do not include tourist taxes or optional services.
Article 5 – Security deposit
Upon arrival, upon delivery of the keys, the resident will pay a security deposit of 250 euros for stays of less than 28 nights and 700 euros for a stay of more than 28 nights. After returning the keys, in the absence of damage noted and after payment for the ancillary services consumed on site, the security deposit will be immediately and fully returned. Otherwise, the deposit will be returned, minus repairs following damage, replacement of missing objects or cleaning of the premises, at the latest within 60 days of the departure of the tenant.
Article 6 – Changes in length of stay
The duration of the stay is that provided in the booking confirmation or in the accommodation offer. Subject to availability and at the discretion of the operating company, the duration of the stay may be extended, without obligation to stay in the same apartment or at the same price. In the event of an accepted extension of stay and the application of a new price, it will apply from the first effective day of the extension.
In the event of early departure, the applicable price will be that corresponding to the duration thus shortened and will apply from the date of arrival. For an initial stay of less than 28 nights, the resident is asked to notify the residence of the new departure date at least 48 hours before it. Failure to comply with this deadline may result in the payment of severance pay ranging from 1 to 2 nights depending on operating criteria. For an initial stay of more than 28 nights, the resident is asked to notify the residence at least 7 days before the desired new departure date. Failure to comply with this deadline may result in the payment of severance pay ranging from 2 to 7 nights depending on operating criteria.
Article 7- Withdrawal / Cancellation / Non-presentation
The customer is reminded, in accordance with article L. 121-21-8 12 ° of the Consumer Code, that he does not have the right of withdrawal provided for in article L. 121-21 of the Consumer Code.
Any cancellation must be notified in writing to the operating company. The effective date of a written cancellation will be the date of receipt thereof. In the event of cancellation, compensation must be paid to the operating company according to the application criteria detailed below:
– If your stay is less than 5 nights: any cancellation received less than 24 hours from the date of the scheduled date Arrival will be subject to cancellation compensation equal to one night’s stay.
– If your stay is between 5 and 27 nights: any cancellation received less than 48 hours from the day of the scheduled date of arrival will be subject to a cancellation indemnity equal to 2 nights of stay.
– If your stay is 28 nights or more: any cancellation received less than 72 hours from the day of the scheduled date of arrival will be subject to a cancellation indemnity equal to 4 nights of stay.
Failure to arrive (of the reservation) in the absence of cancellation will be deemed to be a “no show” or “no show” and will be subject to the compensation specified above.
Certain exceptional or special rates may be “non-refundable” regardless of the date of cancellation. In this case, the cancellation conditions detailed above do not apply and the total prepaid amount cannot be refunded for whatever reason.
Article 8 – Arrival and departure
Key collection takes place from 3 p.m. on the day of arrival. They must be returned before 12 noon on the day of departure. As our establishments have different opening days and times, it is up to the resident to check these when making his reservation and, if necessary, to prevent the establishment from arriving or departing outside opening hours. . The residence will then arrange directly with the resident to communicate the necessary access codes and the procedure to follow.
Article 9 – Obligations of the resident
The apartment will be made available to the resident in a good state of repair. The resident will use the leased premises and their facilities as a “good father”. He must comply with the maximum occupancy standards per rented accommodation indicated on the price lists by type of accommodation and by residence. An inventory appears in each apartment. The resident must check its accuracy and quality upon arrival and report any anomalies, missing or damaged items, if any, to the reception within 24 hours of arrival. When the resident leaves, the inventory and the state of cleanliness of the apartment will be checked by the operating company and any lack of inventory or damage to the apartment will be charged to the resident.
Article 10 – Liability
The operating company cannot be held liable in the event of theft or damage to personal effects, in apartments, including in individual safes, common premises, parking lots and any other outbuildings or annexes. the residence: as this accommodation contract is subject to the status of residences with services or tourism, the provisions of articles 1952 et seq. of the civil code, relating to hoteliers, are not applicable.
